Miami Kidnapping Offenders Face the Very Real Possibility of Life in Prison
On Saturday, November 5, 2016, an Amber Alert was issued for three-year old Lee Parish after his mother’s boyfriend left his mother at a gas station when she got out to pump gas into the vehicle. Miami Kidnapping Penalties
Under Florida Statute 787.01, kidnapping is defined as the forcible, secret, or by threat confining, abducting, or imprisoning of another person without his or her consent and/or without lawful authority. If the person abducted is under the age of 13, the rules of this statute apply if such confinement is done without the consent of the child’s parent or legal guardian.
Under that same statute, subsection (2), any person who kidnaps another individual is guilty of a felony of the first degree, and as such, is subject to imprisonment for a term of years not exceeding life. The offender is also subject to up to a $15,000 fine.
Under subsection (3)(a) of the same statute, any person who kidnaps a child under the age of 13 and who, in the process, commits one or more of the following:
- Aggravated child abuse;
- Sexual battery against the child;
- Lewd or lascivious battery, lewd or lascivious molestation, lewd or lascivious conduct, or lewd or lascivious exhibition;
- Exploitation of the child or allowing the child to be exploited; or
- A violation related to prostitution or human trafficking
is guilty of a life felony, and is subject to a term of imprisonment for life OR a split sentence that is a term of at least 25 years’ imprisonment, followed by probation or community control for the remainder of the person’s natural life. The offender is also subject to a $15,000 fine.
