Here, our Orlando criminal defense lawyer explains what we know about this case and discusses the specific charges that were filed by prosecutors.
Many With Felony History Charged With 2022 Orlando, FL Nightclub Shooting
Christian Burgos—a Central Florida man with a felony criminal history—has been charged following a lengthy investigation into two shootings at different nightclubs in Orange County, Florida in 2022. On October 29, 2022, six people were shot from a passing vehicle at Toxic Lounge, with one woman suffering severe head trauma.
Local law enforcement authorities suspect the motive behind the shootings was a rivalry between nightclubs. Mr. Burgos is believed to be associated with a club that lost a bid to Toxic Lounge to host a popular rapper. A wide array of different evidence—including a recovered AR-15-style rifle—was used to link Mr. Burgos to both of the shootings. Notably, Mr. Burgos is also a suspect in a Kissimmee homicide related to a robbery.
Defendant Charged With Six Counts of Attempted Murder
The criminal allegations in this case are extremely serious. Mr. Burgos has been charged with six separate counts of attempted murder. Attempted murder charges in Florida are extremely serious felony offenses that carry severe criminal penalties upon a conviction. These charges encompass scenarios where an individual makes a conscious effort to unlawfully kill another person, but ultimately fails to accomplish the act. Crucial elements include:
- Proving the defendant’s clear intent to commit murder;
- Proving that the defendant took a significant step towards completing the murder.
Florida law differentiates between Attempted First-Degree Murder and Attempted Second-Degree Murder. The former is a more serious felony offense that requires a premeditated act. It can carry penalties of life imprisonment. The latter is an act committed in the heat of passion. It carries lesser penalties, but still very serious felony criminal penalties. An attempted murder charge could also be escalated to a felony murder if the victim dies in an ensuing crime, even if death was not the original intention.
Note: Attempted murder with a firearm is a unique criminal issue in Florida. Florida’s “10-20-Life” law can impose mandatory minimum sentences if a firearm was used. The complexity of such cases necessitates that any person facing this type of crime is represented by a top attorney.
